Men's Health Magazine has published the six personality types that you should not hire, but in our line of work, as attorneys, I can suggest to you that you should avoid, as much as possible, these types. Whether working with them or against them, these people are problems.
I remember when McDonald's added lettuce and tomato to its hamburgers years ago, and then came out with an advertising campaign treating it like it was a new phenomenon. The hamburger chain finally caught on to what the entire World already knew, but it acted like it had found new enlightenment. That is why I found it interesting when More Partner Income directed its reader to a study by Harvard Law School finding that virtual space is replacing office space. Now I like to say that I graduated from Bob's Really Big Law School (formally Fred's), but I already knew this.
I have always taken great interest in what people write to me, even if I do not always agree. Because, whether they like what I say or not, I have always just appreciated the fact that they read what I write.
Apparently in something I wrote I made a comment about Texas Tech University School of Law being located in Lubbock, and made some off handed comment about Lubbock. One reader took offense, stating:
I have been asked to offer more Foonberg, but I can only offer what is posted on YouTube already. However, to find it conveniently, he makes a very good point about being paid. I, unfortunately, primarily practice in an area where this is not possible, but I have always been concerned with attorneys, such as bankruptcy attorneys, who believe that competing on price means taking no money down, even in Chapter 13 cases. The truth of the matter is that the more money or your earnings that you put at risk, the more money you are going to lose, and the less money you are going to make. It is like Vegas. The real slogan of the town should be, "The money you bring to Vegas, stays in Vegas". If you believe your time is valuable, and that your time is the commodity that you sell, then you need to follow this rule. If not for you, then for your family, and those that work for you. For example, when you need to replace your car, and you have to go out and finance it, I can almost guarantee you that looking back, a big part of this situation will have caused by the fact that you did not follow Foonberg's Rule. This rule sounds so painfully obvious, but it is not in practice. The reason is, especially starting out, you feel you need clients and you rationalize that if you push for money they will not retain you. You rationalize that if they will not pay you upfront, that they will pay you after you have demonstrated what great work you have done for them. Even if you do a good job for them, and even if you recover money for them does not mean they want to pay you with it. So, just follow the Rule.
I just love Jay Foonberg. In law school I read his book about surviving in the private practice of law. When I did not have any money to my name, my wife and I traveled to New Orleans to hear him speak. He was one of the few lawyers that spoke in a way that helped my wife and I starting out. In fact if we had followed his advice more completely, we might be even better off today. And then (and I know this could be taken the wrong way, which is not intended), he reminds me a little of the big blue Aardvark in the Pink Panther cartoon series when he speaks. Somehow that always made it more enjoyable for me to hear him speak. It put a smile on my face. So, I thought I would post a short video by Jay Foonberg. Jay we all think you are great.
