Chuck: Great post! I have lived this post. Am presently in a war with counsel for a large auto mfgr and its all about the game. Including the personal attacks in pleadings before a federal judge. At least I can look in the mirror and have respect for myself. You are right on the mark.

What do you mean by "procedural tricks?" I routinely prevail as defense counsel in cases where the other side has made an error in the pleadings, for example. Would you characterize that as a "dark art?" Please explain.

I would say that winning against a defective pleading is winning a fair fight. If nothing else the justice system is about making fights fair and winning or losing a fair fight, isn't it?
